Basel Ban Amendment

Every year, a large amount of dangerous waste moves between countries. The Basel Convention is a convention between countries. It is under the United Nations and has been active since This convention controls the movement of dangerous wastes and wastes collected from households between these countries. The goal is to protect the environment and human health.

Awakening environmental awareness and corresponding tightening of environmental regulations in the industrialized world in the s and s had led to increasing public resistance to the disposal of hazardous wastes — in accordance with what became known as the NIMBY Not In My Back Yard syndrome — and to an escalation of disposal costs. This in turn led some operators to seek cheap disposal options for hazardous wastes in Eastern Europe and the developing world, where environmental awareness was much less developed and regulations and enforcement mechanisms were lacking. The Convention entered into force in The Basel Negotiation Process In June , based on a joint proposal by Switzerland and Hungary, the Governing Council of UNEP mandated the Executive Director to convene a working group with the task of elaborating a global convention on the control of transboundary movements of hazardous wastes, drawing on the previous work undertaken by UNEP and other national, regional and international bodies. The Council also authorized the Executive Director to convene, in early , a diplomatic conference to adopt and sign the convention. This decision and the resulting negotiations were subsequently endorsed by the United Nations General Assembly.

Basel Ban Amendment Guide

Prior to the international aspects of hazardous waste management were addressed in a fragmented and incomplete manner. The roots of the international regime can be traced to Principles 21 and 22 of the Stockholm Declaration. Principle 22 encourages States to cooperate in the development of international law regarding liability and compensation for victims of environmental damage. However, neither principle is of legal force, although Principle 21 has become customary international law and finds more forceful embodiment through mlings of international tribunals. According to the rulings in the Trail Smelter Arbitration 2 and the Corfu Channel case 3 , States have a clear obligation to exercise due diligence regarding hazardous materials within their jurisdictions. In both cases, the fundamental conclusion was that States might be held liable for the negative effects outside their jurisdiction of hazardous materials used within their jurisdiction.

While the Ban Amendment was originally adopted by the parties to the Basel Convention in , it languished pending the need for sufficient ratifications to meet its entry into force threshold. The Basel Convention is a global agreement governing the transboundary movement of hazardous and other wastes. The Convention imposes controls and, in some instances, trade bans on covered waste shipments destined for final disposal or recycling, making the agreement the primary international legal framework governing the circular economy. On September 6, , Croatia submitted its ratification of the Basel Amendment to the depositary, following the ratification deposited by St. Kitts and Nevis on August 29, With those two ratifications, the Ban Amendment has reached the threshold requirement for ratification.

Basel Convention Meetings

Basel Convention , is an international treaty that was designed to reduce the movements of hazardous waste between nations, and specifically to prevent transfer of hazardous waste from developed to less developed countries LDCs. It does not, however, address the movement of radioactive waste. The convention is also intended to minimize the rate and toxicity of wastes generated, to ensure their environmentally sound management as closely as possible to the source of generation, and to assist LDCs in environmentally sound management of the hazardous and other wastes they generate.
