The theory was further developed in the Middle Ages and in the Enlightenment Ages by many a prominent philosopher and economist and has been recognized in the Modern Age. The natural law-theory and system has been repeatedly applied to the spheres of economic thought and has produced many lasting contributions such as private property rights and individual rights. In recent times with the collapses of the financial system and rapid globalization, there has been a renewed interest in the application of natural law theory to economics to counter a certain anthropology and distortion of values created by a modern economic system of self-preservation deriving its insights from the philosophies of Thomas Hobbes and Niccolo Machiavelli.

Introduction Walter Sinnott-Armstrong and Frederick Schauer Epistemology and the philosophy of law are both thriving, but it is unfortunate that there is so little interaction between the two. Law is not listed in the index to the admirable Blackwell Companion to Epistemology, and its entry on evidence moves on quickly after distinguishing what epistemologists and lawyers mean by evidence. The Oxford Handbook on Epistemology also has no index entry on law and only one short discussion of how psychology has affected evidence law. Perhaps more surprisingly, the Oxford Handbook of Jurisprudence and Philosophy of Law has 1, pages with no article or even entry in its index on evidence and only two pages that refer to epistemology. The Blackwell Companion to Philosophy of Law and Legal Theory does have one short article on evidence, but only one mention of epistemology or evidence outside of that article.

Many proponents of traditional knowledge TK seek legal protection comparable to the bundle of exclusive rights afforded creators of knowledge goods in the conventional intellectual property IP system. This chapter argues that the nature of the harm caused by such misuse differs meaningfully from the interests with which standard intellectual property law is occupied. It maps how private law claims have been applied, notably in Australia, to address TK misuse and highlights formal adherence by courts to the boundaries of private law subjects. The chapter identifies three types of harm that flow from the misuse of TK: relational harm, communal harm, and developmental harm. For such harms, individual private property—and common property for that matter—offers limited recourse.
